Article 1: General Provisions and Scope

1.1 These Terms and Conditions of Sale (hereinafter "T&Cs") define the rights and obligations of the parties in connection with the online sale of products offered by Jobin Entrepreneuriat, a micro-enterprise registered in France, operating the site Calvara.design.co.uk (hereinafter "the Company").

1.2 Any order placed on www.calvara.design.co.uk implies prior, full, and unreserved acceptance of these T&Cs, which are governed by French law. These T&Cs form an integral part of the contract concluded between the Customer and the Company. They are fully binding on the Customer, who declares having read and accepted them without restriction or reservation before placing their order.

1.3 These T&Cs apply to any order placed by an adult individual acting as a consumer within the meaning of the preliminary article of the French Consumer Code. The Customer confirms that they are an individual aged at least 18 years, acting for purposes outside of any trade, business, craft, or profession. They acknowledge having full legal capacity to enter into a binding agreement when placing an order and undertake to provide accurate information regarding their identity.

1.4 These T&Cs expressly exclude persons acting in a professional capacity. Professionals wishing to place an order with the Company are invited to contact us directly at support.calvaradesign@gmail.com.

1.5 The T&Cs applicable to each order are those in force on the date of payment. The Company reserves the right to modify them at any time by publishing a new version on its website. These T&Cs are permanently available at: www.calvara.design.co.uk.


Article 2: Formation of the Online Contract

2.1 Order process

To purchase one or more products on Calvara.design.co.uk, the Customer selects each product and adds it to their basket. Once their selection is complete, they confirm their basket to proceed to checkout (1st click).

At this stage, the Customer is directed to a page displaying a full summary of the selected products, the corresponding prices, delivery terms and conditions, and these T&Cs, which they must read carefully before confirming their order.

Confirming the order after reviewing the basket and reading the T&Cs (2nd click) constitutes conclusion of the contract. The Customer expressly acknowledges that this 2nd click creates a payment obligation on their part, in accordance with Article L221-14 of the French Consumer Code.

The Customer is then redirected to the secure payment page. After confirming their order and payment, the Customer receives a confirmation email at the address provided during checkout, containing a full order summary, order number, withdrawal terms and form, and these T&Cs.

If the confirmation email is not received, the Customer is advised to check their spam folder before contacting the Company at support.calvaradesign@gmail.com.

The Customer then receives a purchase invoice in electronic format, which they expressly accept. The Customer is strongly advised to retain this confirmation and invoice as proof of contract.

2.2 Right to refuse an order

The Company reserves the right to refuse any order on any legitimate grounds, including:

  • Order not compliant with these T&Cs
  • Quantities ordered inconsistent with normal consumer use
  • Non-payment of a previous order or ongoing dispute regarding a previous order
  • Suspected fraud
  • Incomplete or incorrect delivery or payment information

In the event of a refusal, the Company undertakes to notify the Customer by email as soon as possible.


Article 3: Product Specifications and Availability

3.1 Product specifications

The essential characteristics of products and their respective prices are made available to the Customer on the Company's website. The parties agree that illustrations, videos, or photos of products offered for sale have no contractual value. The validity period of product offers and their prices is specified on the Company's website.

The Company takes reasonable care to ensure that product descriptions are accurate but accepts no liability for any errors that may appear in such descriptions.

3.2 Product availability

Product offers are valid subject to availability from our partner suppliers. Adding a product to the basket does not guarantee the availability of that product or its price at the time the order is confirmed.

In the event that a product becomes unavailable after the order is confirmed, the Company will notify the Customer immediately by email. The order will be automatically cancelled for the product concerned and the Company will issue a full refund of the price of that product within a maximum of 14 days to the payment method used for the order.

If the order contains other available products, these will be delivered to the Customer under normal conditions.


Article 4: Product Prices

4.1 Prices displayed on the site

Prices of products offered on Calvara.design.co.uk are displayed in pounds sterling (GBP). As the Company benefits from the VAT exemption regime under Article 293 B of the French General Tax Code, VAT is not applicable to sales made on Calvara.design.co.uk. The displayed price is the final price paid by the Customer, including delivery costs for all orders delivered within the United Kingdom.

4.2 Price changes

The Company reserves the right to modify product prices at any time, in compliance with applicable law. Products ordered will be invoiced based on the price in force at the time the order is confirmed. Any price change after order confirmation cannot affect the price agreed between the parties.

4.3 Delivery costs

Delivery is free on all orders delivered within the United Kingdom.


Article 5: Payment

5.1 Time of payment

Full payment of the order must be made at the time of order confirmation. The order is only considered definitively confirmed upon receipt and confirmation of payment in full by the Company.

5.2 Payment methods

To pay for their order, the Customer may choose from the following payment methods available on Calvara.design.co.uk:

  • Credit/debit card: Visa, Mastercard, American Express. Card payments are processed via a PCI-DSS certified secure payment platform. Banking information is protected by SSL encryption. The Customer warrants that they are authorised to use the chosen payment method.
  • Apple Pay: secure payment via Apple digital wallet.
  • PayPal: payment via PayPal is accepted. When using this method, PayPal's Terms and Conditions apply in addition to these T&Cs.
  • Gift vouchers and promotional codes: vouchers and promotional codes issued by the Company may be used to pay for all or part of an order. They are valid for single use only and are neither refundable nor reissued in the event of a return.

5.3 Payment refusal and security

In the event of payment authorisation refusal or non-payment, the Company reserves the right to suspend and/or cancel the order without notice. The Company may implement an order verification procedure to ensure that no person uses another person's banking details without their knowledge.


Article 6: Delivery and Receipt

6.1 Delivery

Calvara.design.co.uk delivers exclusively to the United Kingdom. Products are dispatched from our international partner warehouses.

The estimated total delivery time is 12 to 18 working days after order confirmation. Items are prepared and dispatched within 2 to 3 working days, then delivered within 10 to 15 working days. These timeframes are provided as a guide and do not constitute a contractual guarantee.

Delivery will be made to the address provided by the Customer at the time of ordering. The Customer is solely responsible for any delivery failure resulting from incomplete or incorrect information provided.

In the event of a lost parcel or significant delay, the Customer is invited to contact the Company at support.calvaradesign@gmail.com so that the necessary steps can be taken with our logistics partners.

6.2 Receipt

Upon receipt of the product, the Customer undertakes to verify that the product is complete and undamaged. In the event of an anomaly upon receipt, the Customer must:

  • Issue written, precise, and detailed reservations on the carrier's delivery note
  • Photograph the parcel and any damaged items before any further opening
  • Contact the Company's customer service at support.calvaradesign@gmail.com within a maximum of 48 working hours following the date of receipt

Any complaint submitted outside this timeframe cannot be accepted by the Company.


Article 7: Right of Withdrawal

7.1 Principle and timeframe

In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has the right to withdraw from the contract without giving any reason within 30 calendar days from the date of receipt of their order. For orders involving multiple products delivered separately, the period begins upon receipt of the last product.

Upon valid exercise of the right of withdrawal within the above timeframe, the price of the product(s) purchased will be fully refunded to the payment method used for the order, within a maximum of 14 days from receipt of the withdrawal notification by the Company, in accordance with Article L221-24 of the French Consumer Code. Return postage costs remain the sole responsibility of the Customer.

7.2 Exceptions to the right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for the following:

  • Supply of goods made to the Customer's specifications or clearly personalised
  • Supply of goods liable to deteriorate or expire rapidly
  • Supply of goods which have been unsealed by the Customer after delivery and which cannot be returned for hygiene or health protection reasons
  • Supply of goods which, after delivery, are by their nature inseparably mixed with other items

7.3 How to exercise the right of withdrawal

To exercise their right of withdrawal, the Customer must notify the Company of their decision by sending an unambiguous statement expressing their wish to withdraw, either using the model form below or by email to support.calvaradesign@gmail.com, before the 30-day period expires.

This form may be sent by email to support.calvaradesign@gmail.com or by post to the address above.

The Customer has 30 days from sending their withdrawal notification to return the product in its original packaging. Return postage costs are the sole responsibility of the Customer.

Products must be returned in their original condition and complete (packaging, accessories, instructions) to allow resale. In the event of receipt of opened, used, incomplete, or damaged products, the Company may issue a partial refund based on the depreciation observed.


Article 8: Guarantees

8.1 Statutory guarantee of conformity

The Company is bound by the guarantee of conformity of goods in accordance with Articles L217-4 et seq. of the French Consumer Code.

When acting under the statutory guarantee of conformity, the Customer:

  • Has a period of 2 years from delivery of the goods to take action
  • May choose between repair or replacement of the product, subject to the cost conditions set out in Article L217-9 of the French Consumer Code
  • Is exempt from providing proof of the existence of the lack of conformity for 24 months following delivery of the goods

8.2 Statutory guarantee against hidden defects

The Company is bound by the guarantee against hidden defects in the goods sold, in accordance with Articles 1641 et seq. of the French Civil Code. The Customer may choose between cancellation of the sale or a reduction in the sale price, in accordance with Article 1644 of the French Civil Code.

These statutory guarantees apply independently of any commercial guarantee.

8.3 Reproduction of applicable legal texts

Article L217-4 of the French Consumer Code: "The seller delivers goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the latter was made his responsibility by the contract or was carried out under his responsibility."

Article L217-5 of the French Consumer Code: "The goods conform to the contract: 1° If they are fit for the purpose usually expected of similar goods and, where applicable: if they correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model; if they present the qualities that a buyer may legitimately expect in view of public statements made by the seller, the producer or his representative, in particular in advertising or labelling; 2° Or if they present the characteristics defined by mutual agreement between the parties or are suitable for any special use sought by the buyer, brought to the seller's attention and accepted by him."

Article L217-9 of the French Consumer Code: "In the event of a lack of conformity, the buyer chooses between repair and replacement of the goods. However, the seller may not proceed according to the buyer's choice if that choice entails a cost that is manifestly disproportionate compared to the other option, taking into account the value of the goods or the significance of the defect. He is then required to proceed, unless impossible, according to the option not chosen by the buyer."

Article L217-12 of the French Consumer Code: "Action arising from a lack of conformity is time-barred after two years from delivery of the goods."

Article 1641 of the French Civil Code: "The seller is bound by the guarantee on account of hidden defects of the thing sold which render it unfit for the use for which it was intended, or which so diminish that use that the buyer would not have acquired it, or would only have given a lesser price for it, had he known of them."

Article 1648 of the French Civil Code: "The action resulting from redhibitory defects must be brought by the buyer within two years from the discovery of the defect."

8.4 Supplier commercial guarantee

Certain products sold on Calvara.design.co.uk may benefit from a commercial guarantee granted by the supplier or manufacturer, to which the Company is not directly party. The existence of such guarantees is mentioned, where applicable, on the specific product page. The benefit of a commercial guarantee does not affect the application of the statutory guarantees referred to in Articles 8.1 and 8.2 of these T&Cs.


Article 9: Personal Data Protection

In the context of the commercial relationship, the Company, as data controller within the meaning of the GDPR (EU Regulation 2016/679), collects the personal data necessary for processing the order, managing the commercial relationship, and complying with its legal and regulatory obligations.

Data collected is retained for the following periods:

  • Order and billing data: 10 years in accordance with French accounting and tax obligations
  • Commercial relationship data: 3 years from the last purchase or last interaction
  • Browsing data: maximum 13 months

This data is intended for internal use by the Company but may be shared with companies involved in fulfilling the order, including those responsible for delivery or payment processing.

In accordance with the GDPR and the French Data Protection Act, the Customer has the following rights over their personal data: right of access, right to rectification, right to erasure, right to restriction of processing, right to object, right to data portability, right to withdraw consent, and the right to lodge a complaint with the CNIL (www.cnil.fr).

To exercise their rights, the Customer may send a request by email to support.calvaradesign@gmail.com. A response will be provided within a maximum of one month.

Article 10: Intellectual Property Rights

Trademarks, domain names, products, software, images, videos, texts, and any other information protected by intellectual property rights present on Calvara.design.co.uk are and remain the exclusive property of the Company or their respective original owner. No transfer of intellectual property rights is made through these T&Cs. Any reproduction, representation, modification, publication, or adaptation of all or part of these elements is prohibited without the prior written authorisation of the Company, under penalty of legal proceedings in accordance with Articles L335-2 et seq. of the French Intellectual Property Code.


Article 11: Force Majeure

The Company shall not be held liable for failure to perform its obligations in the event of force majeure or an unforeseeable event within the meaning of Article 1218 of the French Civil Code. Events considered as force majeure include natural disasters, carrier strikes, pandemics, government decisions, or any other event beyond the Company's reasonable control. The Company will notify the Customer of the occurrence of such an event as soon as possible.


Article 12: Limitation of Liability

The Company's liability shall only be engaged for direct and foreseeable damages resulting from a breach of its contractual obligations, within the limits permitted by French consumer law. The Company shall not be held liable for any loss or damage resulting from improper use of the product(s) by the Customer.


Article 13: Account Suspension and Termination

The Company reserves the right to suspend or terminate the account of any Customer who breaches these T&Cs or applicable legal provisions. Any person whose account has been suspended may not subsequently place orders or create a new account without the Company's prior authorisation.


Article 14: Archiving and Proof

Unless proven otherwise, information recorded by the Company constitutes proof of all transactions between the Company and its Customers.

For each order, the order summary is sent by email to the Customer and archived by the Company for 10 years under reasonable security conditions, in accordance with applicable legal obligations. These records are considered as proof of communications, orders, payments, and transactions between the Customer and the Company, in accordance with Article 1360 of the French Civil Code.

The Customer may access archived records relating to them upon request to support.calvaradesign@gmail.com.


Article 15: Severability and Modification of T&Cs

If any provision of these T&Cs is found to be invalid under applicable law, it shall be deemed unwritten but shall not affect the validity of the remaining provisions.

Any tolerance by the Company in the application of all or part of the obligations set out in these T&Cs shall not constitute a modification of the T&Cs nor create any right for the Customer.


Article 16: Governing Law and Dispute Resolution

These T&Cs are governed by French law.

In the event of a dispute, the Company's customer service team is available to seek an amicable resolution at support.calvaradesign@gmail.com.

In accordance with Articles L611-1 et seq. of the French Consumer Code, if no amicable resolution is reached within one month, the Customer may refer the matter free of charge to the competent consumer mediator:

In the event of mediation failure, the competent French courts within the jurisdiction of the Company's registered office shall have sole jurisdiction.
